Terms of Service

Scope

Welcome to Machinami. These Terms of Service (the “Terms”) are between you and the Machinami application provider identified on the App Store product page (“we,” “us,” or “our”). They govern the rights and responsibilities that apply when you download, purchase, access, or use Machinami and its related online features.

Please read these Terms carefully before using Machinami. By selecting an option to accept, completing a purchase, or using Machinami, you acknowledge that you have read and agreed to these Terms. If you do not agree, do not purchase or use Machinami.

These Terms do not exclude or limit any consumer right that applicable law does not permit you to waive by contract.

  1. Machinami is an immersive map and Street View browsing app for Apple Vision Pro. It may provide map browsing, Street View, place search, favorites, and related features.
  2. Unless the App Store presents a separate custom license agreement from us, the license to the Machinami software is also subject to the Apple Standard End User License Agreement. The app is licensed, not sold, to you.
  3. These Terms primarily govern Machinami’s online services, app features, third-party content, and rules of use.
  4. Machinami’s handling of personal information and device data is separately governed by the Machinami Privacy Policy.
  5. Terms from Apple and third-party service providers may also apply to you. Each set of terms governs its corresponding software license, transaction, or third-party service.

Eligibility

  1. You must have the legal capacity to enter into these Terms under the laws that apply where you live.
  2. If you have not reached the age at which you may independently enter into a contract where you live, a parent or legal guardian must read and agree to these Terms and supervise your use of Machinami.
  3. If you use Machinami on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

App features

Machinami features may be divided into two categories:

  • Base features: Basic map and Street View browsing, including medium-quality Street View.
  • Advanced features: High-quality Street View, place-search autocomplete, and other features clearly labeled as advanced in the app.

The features available to you depend on the app version you use, device compatibility, your region, and what the app currently displays.

“Medium quality” and “high quality” are relative quality levels within Machinami. They do not guarantee a fixed resolution, pixel count, or visual result. Actual results may vary because of the Street View source, capture date, network conditions, device performance, service load, and third-party content availability.

During loading or after a failed request, the app may temporarily display preview quality or another lower available quality. High-quality viewing generally uses more network data, loading time, processing resources, and local cache storage.

Base app license

  1. After obtaining Machinami through an authorized channel, you may use its base features in accordance with these Terms, Apple’s usage rules, and applicable law.
  2. Medium-quality Street View is a base feature of Machinami.
  3. Obtaining a license to use Machinami does not mean that:
    • You own the Machinami software, trademarks, or third-party content;
    • Every feature added in the future must be included in the license you already obtained;
    • Separately released apps, major versions, or other products are automatically included in your current license; or
    • Services that depend on the internet or third-party providers must operate permanently or without interruption.
  4. We will not reclassify a base feature expressly identified in these Terms as an advanced feature merely by renaming it. Reasonable changes required by security, legal, technical, or third-party service conditions are handled under Section 10.
  5. New features, content, or services may be designated as base or advanced features, but we will describe that designation clearly before making them available to users.

Advanced features

  1. Advanced features currently include:
    • High-quality Street View;
    • Place-search autocomplete; and
    • Other content clearly labeled as advanced in the app.
  2. You must have a currently valid right to use advanced features before you can access them.
  3. The specific method of providing advanced features, their availability period, transaction terms, price, currency, taxes, and whether they renew are not fixed in these Terms. The app interface or transaction confirmation page shown before you obtain the relevant features will control those details.
  4. We will explain material transaction conditions clearly and in an understandable manner before you confirm a transaction.
  5. A right to use advanced features only permits access to those features. It does not give you ownership of Google maps, Street View imagery, place data, or other third-party content.
  6. Advanced features may be limited by device compatibility, system version, region, network conditions, service capacity, and third-party service availability.
  7. If a transaction is refunded, revoked, determined to be invalid, or lawfully canceled, the corresponding right to use advanced features may also end.

Pricing, payment, and refunds

  1. These Terms do not state fixed prices. The actual price, currency, taxes, and settlement conditions for each transaction are those shown before you confirm it.
  2. Transactions completed through a third-party app distribution or payment platform are also subject to that platform’s payment, billing, and refund rules.
  3. Before confirming a transaction, review the features, applicable conditions, usage period, and amount to be paid.
  4. For transactions completed through the App Store, you can use Apple’s Report a Problem page to review a transaction or request a refund.
  5. These Terms do not exclude any mandatory right you may have to a refund, repair, repeat performance, price reduction, or other remedy under applicable law.

Google Maps, Street View, and other third-party services

  1. Machinami includes maps, Street View, place search, and related content provided through Google Maps Platform.
  2. When you use these features, that use is also subject to the then-current Google Maps End User Additional Terms of Service and Google Privacy Policy.
  3. Maps, Street View imagery, place information, trademarks, attribution, and other Google content are owned by Google or its licensors. Unless applicable third-party terms or law expressly permit it, you may not:
    • Bulk download, scrape, copy, index, resell, rehost, or redistribute that content;
    • Remove, obscure, or alter attribution, copyright, or trademark notices belonging to Google or other rightsholders;
    • Use that content to create a substitute map, Street View service, place directory, or other dataset; or
    • Circumvent access, caching, quota, or security restrictions imposed by the app or third-party services.
  4. Google or other service providers may independently process search terms, network information, location, or data associated with map requests. The Machinami Privacy Policy will describe Machinami’s handling, while the relevant third-party privacy policies describe their handling.
  5. Third-party content may be incomplete, inaccurate, outdated, or unavailable in some regions. Conditions shown in Street View may differ from current real-world conditions.
  6. Machinami does not provide navigation, emergency response, surveying, law-enforcement, medical, or other safety-critical services. Do not rely solely on app content for decisions that may affect personal, property, or public safety.

Acceptable use

When using Machinami, you must not:

  1. Violate applicable law, regulatory requirements, these Terms, or applicable third-party terms;
  2. Circumvent transaction verification, feature access controls, security protections, usage limits, or service quotas;
  3. Use automated software to make bulk requests to, scrape, or stress-test Machinami or a third-party service;
  4. Interfere with servers, networks, app operation, or another user’s normal use;
  5. Distribute malicious code or attempt to obtain API keys, tokens, internal interfaces, or other nonpublic credentials;
  6. Copy, modify, decompile, resell, or distribute Machinami without authorization, except to the extent applicable law expressly permits the activity;
  7. Use Machinami to infringe another person’s privacy, intellectual-property rights, or other legal rights; or
  8. Use Machinami for harassment, stalking, threats, fraud, or other harmful activity.

Immersive experience and safety

  1. Before using immersive Street View, make sure your surroundings are safe and follow the Apple Vision Pro safety guidance.
  2. Stop using the app and take an appropriate break if you experience dizziness, nausea, visual fatigue, disorientation, or other discomfort.
  3. Do not use immersive features while driving, operating machinery, walking in a hazardous area, or performing an activity that requires continuous attention to your physical surroundings.
  4. A parent or guardian should supervise a minor’s use based on the minor’s age, health, and physical surroundings.

Service availability, changes, and discontinuation

  1. Machinami depends on network connectivity, Apple platforms, Google Maps Platform, cloud infrastructure, and other external conditions. We therefore cannot guarantee that every feature will be available at all times, in every region, on every device, or in every language.
  2. We may maintain, limit, change, suspend, or discontinue part of the service for reasonable reasons, including:
    • Fixing faults, improving performance, or releasing updates;
    • Addressing security risks, abuse, fraud, or abnormal usage;
    • Complying with law, regulatory requirements, or third-party terms;
    • Changes to third-party services, interfaces, licenses, pricing, or content;
    • Material changes in capacity, technical feasibility, or the conditions required for continued operation; or
    • Force majeure or another event beyond our reasonable control.
  3. When a foreseeable change will materially affect base features or paid features you have already obtained, we will give advance notice through the app, website, or another appropriate channel where reasonably practicable. This does not apply when an urgent security event, legal requirement, or sudden third-party service interruption prevents advance notice.
  4. A change to a third-party service does not, by itself, automatically exclude all responsibility we may have to users.
  5. If a paid feature you have obtained is materially unavailable for an extended period for reasons within our control, we will consider restoring the service, providing an alternative, assisting with a refund, or offering another appropriate remedy based on the extent of the failure, applicable law, and the transaction platform’s mechanisms.
  6. If we plan to permanently discontinue Machinami’s core online services, we will provide advance notice where reasonably practicable, stop selling materially affected features, and address any unperformed paid service as required by applicable law.
  7. Brief maintenance, missing individual items of content, or a nonmaterial interruption does not automatically create a right to a refund or compensation. This does not affect any mandatory right you have under applicable law.

Privacy and permissions

  1. We handle data associated with app operation in accordance with the Machinami Privacy Policy.
  2. Map-location features are used only after the relevant system permission is granted. You can withdraw location or another system permission in system settings, but doing so may make the corresponding feature unavailable.
  3. In-app privacy choices for diagnostics and crash reports can be adjusted in the relevant Machinami settings. After automatic sharing is turned off, the app may ask whether you want to share the relevant report the next time it launches after a crash.
  4. Refusing a permission that is not required for a feature does not prevent you from continuing to use other features that do not depend on that permission.
  5. The Privacy Policy will describe the specific handling of location, search content, diagnostics, favorites synchronization, and third-party processing. These Terms do not replace those disclosures.

Intellectual property

  1. The Machinami software, interface, design, text, icons, trademarks, and original content are owned by us or the relevant rightsholder.
  2. Google maps, Street View imagery, place information, and related attribution are owned by Google or its licensors.
  3. These Terms grant only a limited, nonexclusive, nontransferable license to use Machinami through its intended app features. They do not grant any other express or implied intellectual-property license.
  4. Providing feedback or suggestions does not transfer ownership of your pre-existing content to us. You permit us to use general feedback to improve the product without identifying you.

Disclaimers and limitation of liability

  1. To the maximum extent permitted by applicable law, Machinami is provided “as is” and “as available.”
  2. We do not guarantee uninterrupted or error-free service, or that map coverage, Street View dates, place results, autocomplete suggestions, or visual quality will meet a particular purpose in every circumstance.
  3. Our responsibility for loss caused by inaccurate third-party content, changes in real-world conditions, a user’s failure to follow safety guidance, or use outside the app’s normal purpose is limited to the extent permitted by applicable law.
  4. To the extent permitted by law, we are not responsible for indirect losses that were not reasonably foreseeable, or for losses caused by a user’s intentional misconduct, gross negligence, unlawful use, or unauthorized circumvention of security measures.
  5. These Terms do not limit liability arising from our intentional misconduct or gross negligence, or liability relating to personal injury, fraud, consumer protection, data protection, or any other matter that the law does not permit us to exclude or limit.

Suspension and termination

  1. If you seriously or repeatedly violate these Terms, third-party terms, or applicable law, we may suspend or terminate your access to the relevant features.
  2. Where security and law permit, we will explain the primary reason and provide a reasonable way to appeal or correct an obvious error.
  3. We may restrict access immediately in response to an urgent security risk, fraudulent transaction, credential abuse, or a legal requirement that requires immediate action.
  4. You may stop using and uninstall Machinami at any time. Uninstalling the app does not automatically reverse a completed transaction.
  5. Refunds and other remedies following termination of a service are handled under the transaction platform’s rules, applicable law, and the service-discontinuation provisions of these Terms.

Changes to these Terms

  1. We may revise these Terms because of feature changes, legal requirements, security needs, or updates to third-party terms.
  2. For a change that may materially affect your rights, we will provide a new effective date through the app or website within a reasonable period.
  3. Changes generally apply prospectively. We will not deprive you of a paid feature you have already obtained merely by making a retroactive change to these Terms.
  4. If applicable law requires separate express consent, we will ask for your consent before the new terms take effect.
  5. If you do not agree to the revised Terms, you may stop using Machinami. Transactions already completed, refunds, and statutory rights continue to be handled under the applicable rules.

Dispute resolution

  1. If you have a question, complaint, or dispute concerning these Terms, Machinami, or a related transaction, you may contact us at the email address stated in these Terms to seek an informal resolution.
  2. If the dispute cannot be resolved informally, you may seek a remedy from a court with jurisdiction, a consumer-protection body, or another dispute-resolution body established by law.
  3. If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions are not affected.
